Terms of Service

These Terms of Service (“Terms”) govern access to and use of ConfirmPH, including its websites, applications, public pages, renter tools, business tools, booking features, reviews, support services, and related functionality. In these Terms, “ConfirmPH,” “we,” “us,” and “our” refer to the operator of the ConfirmPH platform. These Terms are the general rules that apply to use of ConfirmPH. If you use ConfirmPH as a customer or renter, the Customer / Renter Terms also apply. If you use ConfirmPH for a rental business, the Business Terms also apply.

Related policies

Other policies may also apply, including the Privacy Policy, Cookie Policy, Reviews Policy, Trust & Safety Policy, Acceptable Use Policy, Refund & Billing Policy, Data Deletion Policy, and any feature-specific, subscription, integration, or additional terms expressly presented to you.

If a role-specific policy conflicts with these Terms concerning a matter specifically addressed by that policy, the applicable role-specific policy will control to the extent of that conflict.

If you do not agree to the Terms that apply to your use of ConfirmPH, do not use the applicable Services.

1. Definitions

For these Terms:

“Business” means a rental business or other business using ConfirmPH for commercial purposes.

“Business User” means an owner, manager, employee, contractor, representative, or other authorized person using ConfirmPH for a Business.

“Customer” means a renter, prospective renter, or other customer interacting with a Business.

“User” means any person who accesses or uses ConfirmPH.

“Booking Request” means rental information submitted for consideration or processing by a Business.

“Booking Record” means rental information recorded in ConfirmPH.

“Customer Confirmation” means a Customer's affirmative confirmation of booking details presented through the applicable ConfirmPH confirmation process.

“Content” means text, information, photographs, documents, listings, reviews, messages, records, files, or other material submitted to or made available through ConfirmPH.

“Subscription” means a paid ConfirmPH plan, recurring service, or paid add-on.

“Services” means ConfirmPH's websites, software, applications, public features, renter features, business features, integrations, and related services.

2. What ConfirmPH is

ConfirmPH is a software and information platform designed primarily for Philippine rental businesses and their customers. Depending on the Services available, ConfirmPH may provide tools relating to:

  • rental discovery
  • public business profiles and listings
  • inquiries
  • booking requests
  • booking records
  • customer confirmations
  • vehicles and fleet operations
  • inspections, damage, incidents, and maintenance
  • customer and staff records
  • reviews
  • notifications
  • public trust signals
  • reporting and moderation
  • integrations
  • subscriptions

support; and

related rental-management functions.

ConfirmPH may work alongside communication, payment, website, and other channels already used by Businesses and Customers.

3. ConfirmPH does not operate rental businesses

Rental businesses using ConfirmPH are independent businesses. Unless ConfirmPH expressly agrees otherwise in a separate written agreement, ConfirmPH does not:

  • own rental vehicles
  • provide the underlying rental
  • employ rental-business staff
  • release vehicles to Customers
  • set rental prices
  • collect or return rental deposits on behalf of every Business
  • independently inspect every vehicle
  • insure rental vehicles
  • register vehicles
  • provide roadside assistance
  • guarantee rental-business performance
  • guarantee Customer conduct
  • guarantee vehicle availability

guarantee vehicle condition; or

become a party to the rental agreement between a Business and Customer.

The underlying rental is provided by the Business. Additional responsibilities are explained in the Customer / Renter Terms and Business Terms.

4. Rental agreements

Unless expressly stated otherwise, the rental agreement is between the Customer and the Business. ConfirmPH is not a party to that rental agreement.

Businesses remain responsible for matters such as vehicles, availability, rental prices, deposits, fees, refunds, cancellations, pickup and return, vehicle condition, insurance, documents, permits, renter eligibility, damage charges, rental policies, taxes, customer service, and legal compliance.

Customers remain responsible for reviewing important rental information and deciding whether to proceed.

5. Eligibility

You must be legally capable of entering into agreements applicable to your use of ConfirmPH.

Additional requirements may apply when renting or driving a vehicle, including minimum age, driver's licence, identification, payment requirements, deposits, residency requirements, or vehicle-specific eligibility. Those requirements are generally determined by the Business and applicable law.

ConfirmPH does not independently determine whether every Customer is legally or otherwise eligible to rent or drive a particular vehicle.

6. Acceptance of Terms

Where ConfirmPH asks you to affirmatively accept Terms, policies, booking terms, or other agreements, you must review them before accepting.

ConfirmPH may retain records relating to acceptance, such as applicable terms version, date and time, account or User identifier, acceptance event, and other reasonable technical records.

For anonymous public visitors, access to the website remains subject to applicable public-use rules and policies.

Where applicable law requires affirmative consent to a particular contractual term or processing activity, ConfirmPH will use an appropriate acceptance or consent mechanism.

7. Accounts

Some Services require an account. You agree to provide information that is accurate and not intentionally misleading.

You are responsible for taking reasonable steps to protect passwords, authentication codes, devices, email accounts, private booking links, confirmation links, review invitations, integration credentials, and other protected access information.

Do not knowingly permit unauthorized access to your account. Notify ConfirmPH promptly if you believe your account, device, private link, or credentials have been compromised.

8. Business accounts and authorized users

Businesses may authorize owners, managers, staff, contractors, or other Business Users to access a Business account. The Business is responsible for managing authorized users, staff roles, permissions, access removal, and activity performed through authorized Business accounts.

ConfirmPH is not the employer of rental-business staff. Employment, compensation, scheduling, labor compliance, and other employment matters remain the responsibility of the Business. See the Business Terms for additional requirements.

9. Limited licence to use ConfirmPH

Subject to these Terms, applicable plan limits, and applicable fees, ConfirmPH grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Services for their intended personal or business purposes.

You must not, except where expressly authorized or legally permitted:

  • resell or sublicense ConfirmPH
  • reproduce substantial portions of the Services
  • reverse engineer protected software
  • attempt to obtain source code improperly
  • bypass security or access controls
  • circumvent rate limits or permissions
  • systematically scrape platform data without authorization
  • interfere with platform operation
  • distribute malware through the Services

provide unauthorized third-party access; or

commercially exploit ConfirmPH outside its intended use.

10. ConfirmPH intellectual property

ConfirmPH's software, interfaces, branding, designs, databases, documentation, graphics, platform technology, and related intellectual property belong to ConfirmPH or its licensors.

Using ConfirmPH does not transfer ownership of that intellectual property to you. Except for the limited rights expressly granted under these Terms, all rights are reserved.

11. Content you provide

You are responsible for Content you submit, upload, import, publish, or otherwise provide through ConfirmPH. This may include:

  • business information
  • listings
  • vehicle details
  • photographs
  • booking information
  • customer information
  • documents
  • messages
  • reviews
  • review replies
  • support requests

incident information; and

other records.

You must have the rights and permissions necessary to provide that Content. You must not knowingly submit Content that is false, fraudulent, forged, unlawfully misleading, threatening, abusive, defamatory, infringing, privacy-invasive, malicious, or otherwise prohibited by applicable ConfirmPH policies.

12. Licence to submitted Content

You retain ownership of Content that you lawfully own. By providing Content to ConfirmPH, you grant ConfirmPH a non-exclusive licence to host, store, process, reproduce as technically necessary, transmit, display according to applicable visibility settings, moderate, and otherwise use that Content as reasonably necessary to operate, secure, support, maintain, and improve the Services.

This licence remains subject to applicable privacy law, the Privacy Policy, contractual restrictions, visibility settings, and applicable intellectual-property rights.

Submitting Content does not automatically grant ConfirmPH unrestricted rights to use personal Content in advertising or promotional campaigns. Where separate permission is appropriate for promotional use, ConfirmPH should obtain it separately.

13. Booking Requests, Booking Records, and Customer Confirmations

A Booking Request means rental information has been submitted for consideration or processing. It does not automatically mean the Business has accepted the rental.

A Booking Record means rental information has been recorded in ConfirmPH.

A Customer Confirmation means the Customer affirmatively confirmed booking details presented through the applicable ConfirmPH confirmation process. A Customer Confirmation records that acknowledgement. It does not mean ConfirmPH independently verified or guaranteed:

  • future vehicle availability
  • vehicle condition
  • payment
  • deposit receipt
  • refund
  • insurance
  • documents
  • Customer eligibility

Business performance; or

successful completion of the rental.

Detailed booking responsibilities are governed by the applicable Customer / Renter Terms and Business Terms.

14. Booking changes

Booking information may change after a Customer Confirmation. Where the platform requires reconfirmation of a material change, the Customer must affirmatively review and accept the updated information through the applicable process.

A Business entering a change into ConfirmPH does not, by itself, establish that the Customer agreed to it.

15. Public listings and Business profiles

ConfirmPH may allow Businesses to publish Content through public profiles, Discover Rentals, vehicle listings, hosted pages, public links, QR codes, reviews, website tools, or other public-facing features.

Businesses are responsible for the accuracy and legality of Content they publish.

ConfirmPH may restrict, moderate, hide, remove, or limit Content where reasonably necessary to address fraud, deception, unlawful activity, impersonation, safety concerns, abuse, spam, misleading information, or policy violations.

16. Search, ranking, and visibility

ConfirmPH may organize or display Businesses, listings, vehicles, reviews, or Content based on platform criteria. Visibility or placement may depend on matters such as relevance, location, profile completeness, activity, customer preferences, reviews, platform signals, moderation, availability of particular features, and other ranking criteria.

ConfirmPH does not guarantee a particular ranking, a particular listing position, a particular number of views, inquiries, bookings, conversions, or revenue.

Sponsored or paid visibility, where available, is separate from organic ranking and should be identified accordingly.

17. Reviews

ConfirmPH may allow eligible Customers to submit reviews and Businesses to respond. Review activity is subject to the Reviews Policy and other applicable policies.

A booking-linked review means the review was submitted through an eligible ConfirmPH booking-review process. It does not mean ConfirmPH independently verified every factual statement in the review.

You must not submit fake reviews, coordinate deceptive review manipulation, impersonate another person, submit prohibited incentivized reviews, threaten or harass users through reviews, disclose private personal information unlawfully, or otherwise misuse the review system.

18. Trust signals and public indicators

ConfirmPH may display informational signals concerning Business profiles, listings, reviews, documents, platform activity, or other recorded information. Unless expressly stated otherwise, these indicators are not government certifications, safety guarantees, insurance guarantees, endorsements, guarantees of legal compliance, guarantees of document authenticity, guarantees of booking fulfillment, or guarantees of a problem-free rental.

The meaning of an indicator should be understood according to the explanation accompanying that indicator. Additional information appears in the Trust & Safety Policy.

19. Payments between Customers and Businesses

Customers and Businesses may make or arrange rental-related payments outside ConfirmPH. Unless ConfirmPH expressly identifies a payment as being processed through a ConfirmPH payment feature, such payment is handled directly between the Customer and Business or through the applicable third-party provider.

ConfirmPH does not automatically guarantee receipt of off-platform payments, deposit return, refunds, reversals, recovery of transferred funds, or authenticity of payment evidence.

Financial records shown in ConfirmPH may reflect information recorded by Users and do not, by themselves, establish that money has been received or refunded. See the applicable Customer / Renter Terms, Business Terms, and Refund & Billing Policy.

20. ConfirmPH Subscriptions and billing

Some Services may require a paid Subscription or add-on. Plan features, limits, pricing, and billing frequency are determined by the information presented at purchase or in the applicable account or pricing information.

Where recurring billing applies, you authorize ConfirmPH and its applicable payment provider to charge the selected payment method until the Subscription is cancelled.

Trials, cancellations, refunds, billing failures, and price changes are governed by the applicable purchase terms and Refund & Billing Policy. ConfirmPH may restrict paid functionality where payment is overdue.

21. Integrations and third-party services

ConfirmPH may interact with third-party services such as hosting providers, email providers, messaging services, payment providers, analytics services, maps, websites, webhooks, APIs, or other integrations.

Third-party services may have separate terms, policies, availability, fees, and security practices. ConfirmPH does not control every third-party service and is not responsible for independent third-party acts or omissions except where applicable law provides otherwise.

Integrations may experience delays, duplicate events, retries, failures, compatibility issues, outages, or changes by third-party providers. Do not rely on a third-party integration as the only control for a legally required or safety-critical activity.

22. Privacy and personal information

ConfirmPH processes personal information as described in the Privacy Policy and applicable privacy notices. Users must not misuse personal information obtained through ConfirmPH.

Businesses are responsible for ensuring that personal data they upload, import, access, or use through ConfirmPH is handled lawfully. Depending on the processing activity, ConfirmPH and a Business may have different obligations under applicable privacy law.

Additional privacy responsibilities may appear in the Business Terms, Customer / Renter Terms, Privacy Policy, or applicable data-processing terms.

23. Acceptable use

You must not use ConfirmPH to commit fraud, operate scams, impersonate others, create fake bookings, upload forged information, manipulate reviews, harass or threaten others, misuse personal information, send unlawful spam, distribute malware, attempt unauthorized access, interfere with platform security, exploit vulnerabilities, scrape data without authorization, circumvent plan or account restrictions, or engage in unlawful activity.

Additional rules are contained in the Acceptable Use Policy, Reviews Policy, and Trust & Safety Policy.

24. Security

You are responsible for using reasonable care when accessing ConfirmPH. ConfirmPH may use security and anti-abuse controls including authentication, protected links, access permissions, rate limits, abuse controls, logging, and other protective measures.

ConfirmPH may temporarily restrict activity where reasonably necessary to protect Users, Businesses, Customers, accounts, private information, or platform security.

No security system can guarantee prevention of every unauthorized access or attack. Report suspected security issues promptly.

25. Service availability

ConfirmPH may modify, improve, add, limit, suspend, or discontinue Services or features from time to time. Availability may be affected by maintenance, software errors, infrastructure failure, internet outages, telecommunications problems, cloud-service failures, third-party providers, security incidents, device limitations, emergencies, weather, or other circumstances outside reasonable control.

ConfirmPH does not guarantee uninterrupted or error-free operation.

26. Support and emergencies

ConfirmPH may provide support through the channels made available on the platform. Unless ConfirmPH has expressly agreed to a specific service level, response or resolution times are not guaranteed.

ConfirmPH is not an emergency-response service. For accidents, injuries, crime, immediate danger, medical emergencies, fire, or other urgent emergencies in the Philippines, contact 911 or the appropriate emergency, medical, police, fire, or roadside service.

Do not rely on ConfirmPH support, notifications, reports, or reviews for emergency assistance.

27. Suspension and termination

ConfirmPH may restrict, suspend, or terminate access where reasonably necessary because of material or repeated violations of these Terms, fraud, suspected fraud, security risks, abuse, unlawful activity, misuse of personal information, payment failures relating to paid Services, platform manipulation, risk to Customers or Businesses, legal requirements, or serious policy violations.

Where practical and appropriate, ConfirmPH may provide notice or an opportunity to correct the issue. Immediate restriction may be appropriate for serious fraud, security, privacy, legal, or safety concerns.

You may stop using ConfirmPH at any time, subject to any Subscription, billing, retention, or contractual obligations that remain applicable.

28. Data following account closure

ConfirmPH does not promise indefinite retention of inactive account data. Subject to applicable law and policy, certain information may continue to be retained for reasons including legal compliance, security, fraud prevention, disputes, billing and tax records, audits, abuse prevention, backup integrity, booking history, or enforcement of legal rights.

Deletion and retention practices are further described in the Privacy Policy and Data Deletion Policy. Where export functionality is available, Users should export records they independently need to retain.

29. No guaranteed outcomes

ConfirmPH provides software and information tools. To the maximum extent permitted by applicable law, ConfirmPH does not guarantee:

  • that every Business or Customer will act honestly
  • successful rental completion
  • vehicle availability
  • vehicle safety
  • Customer eligibility
  • payment completion
  • deposit return
  • refunds
  • positive reviews
  • listing performance
  • business revenue
  • complete detection of booking conflicts
  • complete detection of scams or abuse

uninterrupted Service; or

any particular commercial result.

ConfirmPH does not provide legal, accounting, insurance, mechanical, employment, or regulatory advice merely by providing platform tools.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

30. Limitation of liability

To the maximum extent permitted by applicable law, ConfirmPH will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the Services, including loss of profit, revenue, business opportunity, goodwill, or data, where such exclusion is legally permitted.

For paid Business use, any additional liability limitation applicable to Business accounts may be set out in the Business Terms.

Nothing in these Terms excludes or limits liability where applicable law does not permit such exclusion or limitation. Nothing excludes liability for fraud, wilful misconduct, or other liability that cannot legally be excluded.

31. Indemnity

To the extent permitted by applicable law, a User agrees to indemnify and hold harmless ConfirmPH and its applicable officers, employees, and service providers against third-party claims and reasonable losses arising from the User's unlawful use of ConfirmPH, Content, infringement of another person's rights, fraud, misuse of personal information, material breach of these Terms, or unlawful conduct through the Services.

This does not apply to the extent a claim was caused by ConfirmPH's own unlawful conduct or another matter for which liability cannot legally be excluded. Additional Business indemnity obligations may appear in the Business Terms.

32. Force majeure

Neither ConfirmPH nor a User will be responsible for delay or failure caused by events beyond reasonable control where performance is prevented or materially disrupted. Examples may include natural disasters, severe weather, fire, flood, war, civil unrest, government action, major internet failure, telecommunications failure, widespread cloud-service outage, utility failure, public-health emergencies, or comparable events.

This section does not excuse payment obligations already due.

33. Changes to these Terms

ConfirmPH may update these Terms as the Services change, laws or regulatory requirements change, security requirements change, the business model changes, or related policies change.

The Last updated date will identify the latest revision.

Where a change materially affects existing Users and applicable law requires notice or additional consent, ConfirmPH will use an appropriate notice or consent process. Continued use after updated Terms take effect may constitute acceptance where legally permitted.

34. Electronic communications

You agree that ConfirmPH may provide service-related and contractual communications electronically where permitted by law. These may be delivered through account notices, email, in-app messages, the ConfirmPH website, or another reasonable electronic method.

You are responsible for keeping relevant contact information current.

35. Language

ConfirmPH may provide translations of these Terms for convenience. Unless ConfirmPH expressly states otherwise, the English version controls if there is a conflict or inconsistency between translations, subject to any mandatory rights under applicable law.

36. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines, subject to mandatory rights and protections that cannot legally be waived.

Before commencing formal proceedings, the parties should make reasonable good-faith efforts to resolve disputes through direct communication where appropriate. Any applicable jurisdiction or venue provision must remain subject to mandatory law.

37. General provisions

Entire agreement. These Terms, together with applicable policies and role-specific terms incorporated into them, form the agreement governing the matters they cover.

Severability. If any provision is held invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

No waiver. Failure to immediately enforce a provision does not waive the right to enforce it later.

Assignment. Users may not transfer their rights under these Terms or an account without ConfirmPH's consent except where applicable law provides otherwise. ConfirmPH may assign these Terms in connection with a corporate reorganization, merger, acquisition, sale of assets, or transfer of the Services, subject to applicable law.

No partnership or agency. Use of ConfirmPH does not create a partnership, franchise, joint venture, employment relationship, or agency relationship between ConfirmPH and a User, Business, or Customer.

Survival. Provisions that by their nature should continue after termination, including intellectual-property, confidentiality where applicable, payment, liability, indemnity, retention, and dispute provisions: continue to the extent applicable.

38. Contact

For questions about these Terms, account issues, privacy concerns, abuse reports, security concerns, or platform support, use the official ConfirmPH Contact or Support page.

For rental-specific issues, Customers should generally contact the relevant rental Business directly.

Short summary

ConfirmPH provides software and information tools for rental Businesses and Customers. ConfirmPH is not the rental provider. The rental agreement is generally between the Customer and the Business.

A Booking Record means rental information was recorded in ConfirmPH. A Customer Confirmation means the Customer affirmatively confirmed the booking information presented through ConfirmPH. Neither means ConfirmPH independently guarantees the vehicle, availability, payment, insurance, documents, refund, deposit return, or rental outcome.

Customers have additional obligations under the Customer / Renter Terms. Businesses have additional obligations under the Business Terms.

Users remain responsible for lawful use of the platform and for Content they provide.

ConfirmPH does not guarantee uninterrupted service, successful rentals, positive reviews, listing performance, or particular commercial results.

If there is any conflict between the English version and a translated version of this Policy, the English version controls, subject to any rights that cannot legally be waived or limited.
